Force Majeure
In the event GotAPal.com’s delivery of the Services is delayed, prevented, or otherwise made impracticable by reason of any acts of God, fires, floods, earthquakes, or other natural catastrophes; national emergencies, strikes, lockouts or other labor difficulties; computer "hacking" attack or computer virus; any law, order, regulation or other action of any governing authority; power outages, technical equipment failures, or any other cause beyond GotAPal.com’s reasonable control, then GotAPal.com shall be excused from such delivery to the extent that it is delayed or prevented by such cause.

Limitation of Liability
In no event shall GotAPal.com be liable to any person for any special, general, incidental, indirect, consequential, or punitive damages of any kind, including, without limitation, those resulting from negligent or criminal acts of third parties, loss of use, loss of data, lost profits, or computer hardware damage, in connection with any of its services, the GotAPal.com website (including all information, services, and products that are referenced or linked to in the GotAPal.com website), or any other information, documents, products, software, downloads, repair services, advice, and information provided by GotAPal.com or any of its third-party product or service providers, whether such person is advised of the possibility of such damages.

Right of Refusal
GotAPal.com reserves the right to refuse, suspend or terminate any of its services to any user in its sole discretion, without notice. Reasons for refusing service include, but are not limited to: using computer system fraudulently, illegally, or for propagating libelous or otherwise defamatory, obscene, pornographic, abusive, harassing or threatening material.

Expiration of Time / Services
GotAPal.com reserves the right to expire any unused time or services that remain on users account after a period of one year from date of purchase.

DEFINITION OF SERVICE
For purposes of this Agreement, the term "Service" shall mean the GotAPal.com Online PC Services service, including all technical support, usenet newsgroups, email and other features, products and services provided by GotAPal.com under the service option that you have selected. The Service may be referred to as, "Remote Computer Support", "Virtual On-Site Computer Support Service", "On-Site Computer Support Service", "Online Computer Support", "Drop-Off Computer Support" or "GotAPal.com Online PC Services". As part of the Service, GotAPal.com may license to you, or assist you in licensing from third parties, software (see Section 6 below).

AUTHORIZED USER, USE, AND RESPONSIBILITIES
You represent that: (i) you are 18 years of age or older and you have the legal capacity and authority to bind yourself and your employer, as applicable, to this Agreement; (ii) you consent on behalf of yourself and/or as an authorized representative of your employer, as applicable, to be bound by this Agreement; and (iii) the information you supply to us is correct and complete. You understand that GotAPal.com relies on the information you supply and that providing false or incorrect information may result in Service withholding or delays or the suspension or termination of your customer account. You agree to promptly notify GotAPal.com whenever your personal or billing information changes (including for example, your name, address, telephone number, and credit card number and expiration date).

AVAILABILITY OF SERVICE
The Service you select may not be available at all times, and may not be available in the format generally marketed, and some personal computers may not be able to receive the Service even if initial testing showed that your connection was qualified or your computer environment was suitable. For Remote Computer Support, we will qualify your Internet connection for the minimum line rate (speed) available for support based on our standard line qualification procedures. Gotapal.com requires Internet access; it is your responsibility to ensure that you have adequate connectivity to the Internet. All Services are provided on an AS IS basis. Line rate, access and availability of Service are not guaranteed.

SOFTWARE LICENSES AND THIRD PARTY SERVICES
In connection with our Service, we may provide to you, via download, CD, other media, or other delivery method the use of certain software which is owned by GotAPal.com or its third party licensors, providers and suppliers, and which may be provided free or for a fee, including client and/or network security software ("Software"). We reserve the right to update or change the Software from time to time and you agree to cooperate in performing such steps as may be necessary to install any updates or upgrades to the Software. You may use the Software only as part of or for use with the Service and for no other purpose.
